What You Need to get Started

In order for us to help you get started on your trademark registration application, you’ll need to provide a few pieces of information for the United States Patent & Trademark Office (USPTO) application.

  1. First you’ll need the name (of your business) or your business logo – whichever you want trademarked.
  2. Next you’ll need to provide a description of products or services offered for sale under the trademark.
  3. You will also be asked to provide general information about the company (i.e. name, type, address, state of incorporation, etc.).
  4. Then you’ll have to provide the date of earliest sale to an out-of-state customer (“first use in commerce” date).
  5. Lastly, you will be asked to provide photo(s) of the product(s) offered for sale under the trademark, or examples of advertising & promotional materials (for service marks).

Please note: If you have not yet launched your new business, started using the trademark, or started selling products under the trademark name, consider filing the trademark application on an “intent to use” basis. What Is a Clearance Search?

Now that you have everything you need to file to register your trademark, you can conduct a clearance search. But what is a clearance search? A clearance search is something that companies do before filing the application with the USPTO and it helps your business determine the likelihood of a successful trademark registration.

The clearance search will look for other trademarks that might be considered “confusingly similar” to yours by the USPTO; they are likely to refuse any trademark that is too similar to another already registered trademark.

Now It’s Time to File!

Once we file your application with the USPTO, the process takes a year or more to complete. Our on-site lawyers will still be in contact with you through this process, in case any obstacles arise. If yours is a new trademark, you are likely to get at least one “office action” refusal; but our legal team can help with this.

What Happens Next?

Now that you have filed your application, it’s just a matter of time! Once the USPTO has your application in hand, they will conduct an examination of it. The examination will take 3-6 months to complete. Our legal team will be in contact with you and can help with any issues that arise.
